rue21 filed with the U.S. Bankruptcy Court a notice of additional store closings.
The notice states, “Pursuant to the Store Closing Order and by this written notice (this ‘Additional Closing Store Notice’), the Debtors hereby notify you that they have determined, in the exercise of their business judgment, that each store location set forth on Exhibit 2 is hereby designated as an Additional Closing Store. Parties seeking to object to the application of the Store Closing Order to any of the store locations set forth on Exhibit 2 must file and serve a written objection so that such objection is filed with the Bankruptcy Court on the docket of the Debtors’ chapter 11 cases and is actually received by the Debtors and their counsel no later than seven (7) days after the date that the Debtors served this Notice and the Debtors.”
In addition, “The Consultant’s compensation for the Additional Closing Stores shall be based on the same fee structure as contained in the Consulting Agreement and the Consultant Controlled Expenses for such stores shall be as mutually agreed between the Debtors and Consultant.”
