The U.S. Bankruptcy Court approved Avaya’s joint stipulation and proposed order regarding certain claims filed by the Commonwealth of Virginia Department of Taxation.
As previously reported, “The VA Department of Taxation timely filed Claim No. 3473 filed on July 17, 2017 in the amount of $120,919.10 (the ‘Claim’) in advance of the Governmental Bar Date on account of the prepetition period with respect to the Audit….The Debtors have paid the VA Department of Taxation, in complete and full satisfaction of the Claim and the Audit, $74,415.62 (the ‘Settlement Amount’). Upon the Effective Date, the Debtors shall be authorized to cause their claims and noticing agent to amend the claims register to note the withdrawal of the Claim. The Parties hereto acknowledge and agree that, the Parties do not need to take any further action to seek to reflect the terms of this Stipulation.”
