Appvion’s official committee of unsecured creditors filed with the U.S. Bankruptcy Court a stipulation requesting entry of an order approving amending final D.I.P. order to extend the challenge period of the official committee of unsecured creditors as it relates to pre-petition second lien secured parties and related liens and claims.
Documents filed with the Court note, “Subject to the limitations set forth in paragraph 34 of the Final DIP Order, the Committee has until December 31, 2017 to file or otherwise raise a Challenge Proceeding with respect to the Prepetition Second Lien Parties…. Now, Therefore, the Committee and the Prepetition Second Lien Trustee, by and through their respective undersigned counsel, hereby stipulation and agree as follows: Without prejudice to any further extensions, the Challenge Period, solely for the Committee to commence a Challenge Proceeding against the Prepetition Second Lien Parties, is hereby extended through and including January 15, 2018.”
