Armstrong Energy filed with the U.S. Bankruptcy Court a notice of anticipation of effective date the Company’s Third Amended Joint Chapter 11 Plan and withdrawal of its previously-filed motion for an order extending the exclusive period during which the Company can file a plan and solicit acceptances thereof.
The notice states, “On February 2, 2018, the Court entered an order (the ‘Confirmation Order’) [Docket No. 527] (I) confirming the Debtors’ Third Amended Joint Chapter 11 Plan [Docket No. 453] and (II) approving the sale transaction contemplated therein. The Debtors’ anticipate the effective date of the Plan will occur February 16, 2018 (the ‘Effective Date’). Upon the Effective Date, the relief requested in the Motion will become moot and alleviate the need for a hearing on the Motion. Accordingly, the Debtors withdraw the Motion.”
