The U.S. Trustee assigned to the Cenveo case filed with the U.S. Bankruptcy Court a motion for appointment of a Chapter 11 examiner.
The order states, “Pursuant to the Order Appointing An Examiner pursuant to 11 U.S.C. section 1104(c)(2) (the ‘Appointment Order’ Docket No. 203) dated as of March 15, 2018, the United States Trustee has been directed to appoint an examiner in the above-captioned Chapter 11 cases. Pursuant to the Appointment Order, and after consultation with the foregoing parties-in-interest, the United States Trustee has selected Susheel Kirpalani, Esq., as the examiner in these Chapter 11 cases. To the best of the United States Trustee’s knowledge, Mr. Kirpalani’s connections with the Debtors, its creditors, any other parties-in-interest, their respective attorneys and accountants, the United States Trustee, and persons employed in the Office of the United States Trustee are limited to those connections set forth in the Declaration of Susheel Kirpalani Regarding Eligibility for Appointment As Chapter 11 Examiner for Debtors Cenveo, Inc., filed herewith.”
The Court subsequently issued an order approving the examiner’s appointment and assigning Susheel Kirpalani to the role.
