August 13, 2018 – The Court hearing the Orion Healthcorp case approved the request of Debtor affiliate New York Network Management (“NYNM Management”) to file under seal a list of key employees that are referenced in a Key Employee Retention Plan (“KERP”) for 8 non-executive key employees (the “KERP Participants”) [Docket No. 461]. As previously reported [Docket No. 453], “If such information were to be made public via PACER or on NYNM Management’s case website, confidential information will be disclosed to the detriment of NYNM Management, its estate, its creditors, and the KERP Participants. The public disclosure of the names of the Key Participants may cause distress to such employees, which NYNM Management seeks to avoid.”
