Samson Resources filed with the U.S. Bankruptcy Court a motion (i) to extend the exclusive periods by five months to file and solicit acceptances of a Chapter 11 plan through and including March 16, 2017 and May 16, 2017, respectively; (ii) to strike the committee’s termination motion from the record as a violation of the Debtors’ exclusivity period and (iii) for other sanctions the Court deems appropriate.
The motion explains, “The Debtors confirm their consent, pursuant to rule 9013-1(f) of the Local Rules of Bankruptcy Practice and Procedure of the United States Bankruptcy Court for the District of Delaware, to the entry of a final order by the Court in connection with this Motion to the extent that it is later determined that the Court, absent consent of the parties, cannot enter final orders or judgments in connection herewith consistent with Article III of the United States Constitution.”
