September 27, 2018 – Creditor OHI Asset RO filed with the Court an objection to the fifth monthly application of Pepper Hamilton; CohnReznick LLP; and Norton Rose Fulbright US (collectively, the “Committee Professionals”) for allowance of compensation for services rendered and for reimbursement of expenses as Counsel for the Official Committee of Unsecured Creditors for the period July 1, 2018 to July 31, 2018. The objection [Docket No. 1013] asserts, “CohnReznick failed to sufficiently itemize the expenses it incurred in contrast to prior months when it did not itemize its expenses at all. The Omega Entities therefore object to the allowance of such expenses pending submission by CohnReznick of the requisite expense detail. This objection pertains to requests for interim payment and interim allowance of fees and expenses. The Omega Entities reserve all rights to object to any fees and expenses of the Committee Professionals once a request for final approval is made, on these grounds or on any grounds permissible under section 330, the local fee and expense guidelines of this Court, or other applicable order or law. This includes any further objection based on the amount of the applicable “carve-out,” pursuant to Paragraph 8 Final DIP Order (requiring the Debtors to comply at all times with Budget Requirements, as defined therein) and Section 6.12 of the DIP Credit Agreement (relating to limitations on fees and expenses of professionals).”
The Committee Professionals request allowance (on an interim basis) and payment of fees and expenses in the aggregate amount of $635,385.37 for the period of July 1, 2018 through July 31, 2018; specifically (a) Pepper Hamilton seeks interim compensation of $262,688.40 (80% of $328,360.50) and reimbursement of $20,793.13 in expenses; (b) CohnReznick seeks interim compensation of $148,922.00 (80% of $186,152.50) and reimbursement of $1,703.85 in expenses; and (c) Norton Rose seeks interim compensation of $77,894.00 (80% of $97,367.50) and reimbursement of $1,007.89 in expenses.
