The U.S. Bankruptcy Court issued an order adjourning a hearing to consider (a) Energy XXI’s Plan and extending related deadlines, (b) extending the filing exclusivity period and soliciting exclusivity period and (c) appointing a mediator.
The order states, “The Debtors’ motion seeking approval of the adequacy of the Disclosure Statement Supplement and related solicitation materials (the ‘Disclosure Statement Supplement Motion’) shall be considered and adjudicated by the Bankruptcy Court at a hearing to be held before the Honorable David R. Jones, Chief United States Bankruptcy Judge for the Southern District of Texas, Houston Division at the United States Courthouse, Room 400, 515 Rusk, Houston, Texas 77002 on September 22, 2016 at 10:00 a.m. (Central Time). The Debtors shall file the Disclosure Statement Supplement Motion, including all proposed supplemental disclosures and other exhibits thereto, on September 16, 2016. The deadline for parties in interest to file objections, if any, to the Disclosure Statement Supplement is September 21, 2016 at 12:00 p.m. (Central Time).”
The order continues, “Pursuant to section 1121(d) of the Bankruptcy Code, the Debtors’ Filing Exclusivity Period (as defined in the Bridge Order) pursuant to section 1121(b) of the Bankruptcy Code is hereby extended to the earlier of: (i) October 21, 2016 and (ii) immediately following the conclusion of the Confirmation Hearing.”
